Telangana Government Bans the Registration of Illegal Plots and Buildings:- The Telangana government decided to prohibit the registration of illegal structures and unauthorized layouts. Commissioner and Inspector General of Stamps and Registration, T Chiranjeevulu issued a memo to the Telangana sub-registrars asking them not to register the plots that did not have valid permissions across the state. All the valid permissions should be produced by the seller before registration related to the property. The main objective of the Telangana government is to ban all the illegal layouts and plots. As the legislation holds precedence over a memo, it is quite difficult to defend the ban.
The legal experts say that it is not easy to amend the Stamps and the Registration Act in the state as the list is quite big and it has several issues related to the transfer of the properties. They say that the registration of properties is in the concurrent list and hence the amendment of the act is not an easy task. The Centre will not allow such amendments as they are contrary to the Central act. As per the memo, the Section 172(16) of the Telangana Municipalities Act, 2019 says that no new plot or sub-division should be registered by the respective authority unless it is approved with all the legal documents attached. With the huge increase in illegal registrations and controversies, the government of Telangana decided to take the call.
