AG quits, retains SPP in JJ assets Case

The Karnataka Advocate General (AG) B V Acharya has officially resigned on Wednesday at Bangalore. The move gains prominence as a public litigation pill (PIL) challenged Mr Acharya for holding two positions at the same time. He was the AG and Special Public Prosecutor (SPP) at the same time. The 78-year old Mr Acharya has been holding the position as SPP in the Tamil Nadu Chief Minister J Jayalalithaa disproportionate assets case, since 2004.

As per reports the AG was pressurized by the ruling BJP government in responses to their bosses demand from centre. The BJP wanted him to quit the SPP position. But not yielding to the pressure the Mr Acharya quit his position as the AG. Mr Acharya has never named who from the state government had pressurized him. But as per law only the Chief Minister holds the authority to recommend to the Governor for AG appointment. And in response the Governor appoints the AG.

The SPP position was assigned to Mr Acharya by the Chief Justice of the Karnataka High Court. He had apparently served simultaneously as Advocate-General during 2007-08 at the time of two spells of President's rule, soon after the fall of the BJP-JD(S) coalition government and the seven-day BJP government. This was his fifth attempt in holding dual positions. Incidentally, it was the present government headed by the CM D.V. Sadanada Gowda that had appointed him as the AG, after taking over reigns from Mr Yeddurappa.

The AIADMK though not an ally of the BJP, is still considered as a `natural ally’, by none other than the BJP stalwart L K Advani, during his speech in Chennai earlier. So does the national opposition wants to do a favor to the `normal ally’, is a natural question that arises in the minds of the common man.   And what happens had Mr Acharya planned to quit bowing to pressure………..
