Judiciary and Governance are two parallel estates and interfering between them would not be that good. This sums up the feeling expressed by the Chief Justice of India S H Kapadia on Saturday, New Delhi. The CJI felt that the Judiciary should not govern the nation or evolve policies. Interference would only lead to confronting if the executives refuse to comply with the Judiciary directives.
He also pondered of what action the Judiciary would take if the such evolved policies are disregarded by the executive. The CJI also disapproved a recent Supreme Court judgment which said "right to sleep" was also a fundamental right.
The CJI spoke thus while delivering a lecture on 'Jurisprudence of Constitutional Structure' here at the India International Center. He concluded by emphasizing that judges must strictly adhere to Constitutional principles which were clearly demarcated the separation of powers among the judiciary, the legislature and the executive.
