Bombay High Court Dismisses Petitions of Three Rapists:- The Bombay High Court today upheld the amendment section of the constitutional validity of Indian penal code that deals with repeat offenders in rape cases. Section 376E was introduced in 2013 after the Delhi gang-rape which says that a repeat rape offender should be awarded life sentence or the death penalty. Three such offenders have been awarded death penalty by the sessions court in 2014 during April. The three punished were repeated offenders in two gang rape cases.Both the cases took place in Shakti Mills in July and August 2013.
A division bench of Justices BP Dharmadhikari and Revati Mohite Dere dismissed the petitions today which were filed by the three convicted. “We are of the opinion that section 376 (e) of the IPC is not ultra vires to the Constitution and hence need not be quashed in the present case,” said the court. The trio raped a telephone operator and a photojournalist brutally and are charged.
