Election Commission to hear AAP MLAs office of profit case on July 14

The Election Commission has scheduled to hear the Aam Aadmi Party MLAs’ Office of Profit case on July 14, sources said. Twenty one MLAs of AAP could be potentially disqualified if the EC find them guilty of flouting rules. The Election Commission had taken 'cognisance' of the President's decision against signing the Delhi government’s bill to exclude the post of Parliamentary Secretary from the ambit of office of profit.

On March 13 2015, Delhi Chief Minister Arvind Kejriwal had passed an order appointing his 21 party MLAs as Parliamentary Secretaries. Subsequently, the Delhi government had sought an amendment to the Delhi Members of Legislative Assembly (Removal of Disqualification) Act, 1997.

AAP government wanted a 'retrospective' exemption for the parliamentary secretaries from disqualification provisions. The Bill was forwarded by Lt Governor Najeeb Jung to the Centre, which in turn was sent to the President with its comments. The President did not give his assent to the Bill.

The 21 AAP legislators include Dwarka MLA Adarsh Shastri, Rajouri Garden MLA Jarnail Singh and Tilak Nagar MLA Jarnail Singh and two women MLAs, Alka Lamba and Sarita Singh.

The Election Commission of India, will hear the case against 21 AAP MLAs against whom a petition was filed alleging the legislators have occupied offices of profit in violation of the Constitution. The 21 MLAs and all others concerned parties with the case will be provided a chance to put forward their points. The ECI had earlier issued a show-cause notice to the 21 legislators who were appointed as Parliamentary Secretaries by the Delhi government on March 14 last year.

Sensing disqualification of his MLAs for the illegal occupation in the office of profit seats, Delhi Chief Minister Aravind Kejriwal has already started crying victim and blaming Prime Minister Modi. Kejriwal does not have any dignity and shame in doing illegal activities with full knowledge but blames PM for diverting the attention of his failures.
