Land Mark Judgment of Supreme Court!

Delivering judgment on the petition on freeing IAS officers in Civil Services from political interference and corruption, Supreme Court asked the Center and State Governments to create a Board to take decisions on appoints and transfers of IAS Officers.

The IAS officers should have fixed tenure, SC observed and they should not be transferred frequently otherwise the implementation of the Government schemes will get strained.

The Supreme Court of India also advised IAS Officers not to accept oral instructions from the political leaders.  This will help them from victimizing by those political leaders.

The petitioner is TSR Subramanian the former Cabinet Secretary who filed a PIL along with 82 retired IAS officers. Justice KS Radhakrishnan heading the Bench said “Parliament should enact a law to regulate transfer, posting and disciplinary action of IAS officers and to immunize them from political interference.”

The Bench also expressed its opinion, “Much of the deterioration in the functioning of bureaucracy is due to political interference.”

On the pronunciation of the judgment, Subramanian said, "This is a landmark judgment. Public servants are not private servants".

Subramanian also said, “Today faith in our Constitution has been reaffirmed.  Our faith in the strength of democracy has been reaffirmed because the highest court of the land has recognized the problems.”
