
A Delhi high court in an unusual verdict had decided to frame a man for rape charges after he had faked his marital status to a girl, and married her after converting her to Islam. The girl after marrying had discovered that her husband was already married and tried to commit suicide. She had also lodged a complaint with the police station.
Additional sessions judge T R Naval had allowed the unusual charges of rape against Jamal Nasir, apart from abetment to suicide, concealment of former marriage, fraudulent marriage and cohabitation by including a belief of a lawful marriage.
Jamal had a cloth factory opposite the house of the victim and resided in east Delhi. He had asked the girl to marry him while he told her that he was not married. He had invited the girl inside the factory in June 2001 and in front of four others he married the girl. He introduced one of the person as a Qazi while others as witnesses for the marriage. He also told that she would be converted to Islam after a few recitations from Quran and then they would be married.
After questioning why he couldn't spend the nights at home he told her about his marriage earlier and but had compromised and continued to live with him until one day when the first wife had come to their house and thrashed her. Jamal later shifted her to another house asking her not to see him anymore. This had sent her into depression and had also attempted suicide but was saved with medical interference at the right time.
After being discharged from the hospital, she lodged a complaint saying Jamal, his first wife Musharrat, his brother Anees and his wife Nilofar were responsible for making her end her life.
