Lok Pal: Sec-24 another bone of contention


The Lok Pal bill is in for more controversies and amendments before the all agreed actual bill is slated for practice. Almost all the stake holders in the assembly had some sort of dissent over some part of the bill. The Anna team wanted the CBI to be put in its gambit and the UPA wanted to keep it away. UPA wanted Section 24 and the opposition and many from the anti corruption believe that the section will dilute the powers of the controversial bill.

Section 24 of the bill allows presiding officers to act on the basis of a Lokpal report even before a trial is completed. The Lok Sabha Speaker or Chairman of Rajya Sabha is required to table the Lokpal report and inform Lokpal about the action being taken - or not taken - against the members concerned.

In its dissent note to the standing committee that examined the bill, BJP suggested Article 252 that needs two state assemblies to seek a Central model law. The note referred to Article 253 as an option but with the caveat that allows states to exercise their freedom to choose their own version of the lokayukta.
